By accessing or using the Axiant Partners website and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Description of Service

Axiant Partners is a business loan concierge service that connects business owners with potential lending institutions. We act as an intermediary to facilitate the loan matching process. We do not directly provide loans or make lending decisions.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be a business owner or authorized representative of a business
  • Provide accurate and complete information
  • Have the legal capacity to enter into binding agreements

4. User Responsibilities

You agree to:

  • Provide accurate, current, and complete information in your application
  • Maintain and update your information to keep it accurate
  • Use our services only for lawful purposes
  • Not use our services to transmit any harmful or malicious code
  • Not attempt to gain unauthorized access to our systems

5. Loan Matching Process

Our service includes:

  • Reviewing your business loan application
  • Matching you with up to 3 potential lending institutions based on your profile
  • Facilitating communication between you and potential lenders
  • Providing support throughout the application process

We do not guarantee loan approval, specific interest rates, or loan terms. All lending decisions are made solely by the financial institutions.

6. Fees and Compensation

Our concierge service is provided at no direct cost to you. Axiant Partners receives compensation from various sources, including but not limited to lending institutions for successful matches, data licensing fees, lead generation revenue, marketing partnerships, and other commercial arrangements with third parties. You acknowledge that we may generate revenue through the sharing, licensing, or sale of information you provide, and you will not be charged any fees by Axiant Partners for our matching services.

7. Information Sharing, Licensing, and Commercial Use

By submitting an application and using our services, you expressly acknowledge, agree, and consent to the following:

  • Broad Information Sharing: You consent to our sharing, transferring, licensing, selling, or otherwise disclosing your information to third parties, including but not limited to lending partners, financial service providers, business partners, affiliates, data brokers, marketing companies, advertising networks, service providers, and other commercial entities.
  • Commercial Use and Monetization: You acknowledge that we may use, license, sell, or otherwise monetize your information for commercial purposes, including but not limited to revenue generation through data licensing agreements, lead generation services, marketing partnerships, and other business arrangements.
  • Multiple Third-Party Sharing: You understand and agree that your information may be shared with multiple third parties beyond the initial lending matches, including entities that may contact you regarding various financial products, services, and commercial offers.
  • Marketing and Communications: You consent to receiving communications, including but not limited to phone calls, emails, text messages, and postal mail, from Axiant Partners, our lending partners, business affiliates, marketing partners, and other third parties with whom we share your information.
  • No Limitation on Sharing: You acknowledge that we are not limited in the number of third parties with whom we may share your information, and that such sharing may occur for purposes beyond loan matching, including marketing, advertising, analytics, research, and commercial development.
  • Irrevocable Consent: Your consent to information sharing as described herein is irrevocable and continues to apply even after you cease using our services, subject to applicable law.
  • Privacy Policy Incorporation: You agree that our use, sharing, licensing, and potential sale of your information as described in our Privacy Policy is incorporated into these Terms and Conditions by reference.

You understand that by using our services, you are providing express consent to these information sharing practices, and you waive any right to claim that such sharing was unauthorized or unexpected.

8. SMS/Text Messaging Terms

By providing your mobile telephone number and opting in, you agree to receive recurring SMS/MMS text messages from Axiant Partners related to your inquiry and application, including responses to your request, application status updates, appointment coordination, and information about financing options and related services. These SMS Terms supplement and are incorporated into these Terms and Conditions.

  • Program: Axiant Partners financing assistance and customer-care messaging.
  • Message frequency: varies based on your interaction with us.
  • Cost: Message and data rates may apply. Axiant Partners does not charge for the messages, but your mobile carrier's standard rates apply.
  • Opt out: Reply STOP to any message to unsubscribe at any time. You will receive one confirmation message and no further texts unless you opt in again.

  • Consent not required for purchase: Your consent to receive marketing text messages is not a condition of purchasing or receiving any product or service.
  • Carriers: Mobile carriers are not liable for delayed or undelivered messages, and supported carriers may change.
  • Mobile information privacy: As described in our Privacy Policy, your mobile telephone number and SMS opt-in consent are not shared with or sold to any third parties for their marketing purposes.
  • Eligibility: You must be the account holder of, or authorized to opt in, the mobile number provided, and be at least 18 years of age.

We may modify or terminate the text-messaging program at any time. Your continued participation after changes constitutes acceptance of the updated SMS Terms.

9. No Guarantees

While we strive to match you with appropriate lenders, we make no guarantees or warranties regarding:

  • Loan approval or funding
  • Interest rates or loan terms
  • Response times from lending institutions
  • The suitability of any particular lender for your business

10. Limitation of Liability

To the maximum extent permitted by law, Axiant Partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of Axiant Partners or its licensors and is protected by copyright and other intellectual property laws.

12. Termination

We reserve the right to terminate or suspend your access to our services at any time, without prior notice, for any reason, including if you breach these Terms and Conditions.

13. Changes to Terms

We may modify these Terms and Conditions at any time. We will notify you of any material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the new terms.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of those courts.
